These Terms and Conditions ("Terms") govern your use of the website and services provided by Stealth Protection LLC ("Stealth Protection," "we," "us," or "our"). By accessing our website, booking a service, or using any service we provide, you ("you," "client," or "user") agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services

Stealth Protection provides luxury ground transportation and executive protection services, including airport car service, corporate transportation, hourly and as-directed chauffeur service, secure transportation, event transportation, and executive protection details, serving Westchester County (NY), Fairfield County (CT), and the greater New York City area. Service availability is subject to vehicle and personnel availability, geographic area, and confirmation of your reservation.

2. Bookings and Reservations

  • Reservations may be made through our website, booking platform, phone, or email.
  • A reservation is not confirmed until you receive a confirmation from us.
  • You are responsible for providing accurate and complete booking information, including pickup and drop-off locations, times, passenger count, and contact details. We are not liable for service failures resulting from inaccurate information you provide.
  • We reserve the right to decline or cancel any booking at our discretion, including for safety, capacity, conduct, or availability reasons.

3. Pricing and Payment

  • Rates are quoted based on the service, vehicle, route, duration, and any special requirements, and are confirmed at the time of booking.
  • Quoted fares may not include tolls, parking, airport fees, wait time, additional stops, gratuity, or applicable taxes unless expressly stated.
  • Additional charges incurred during service (extra stops, extended time, wait time, cleaning fees, or damage) will be billed to your payment method on file.
  • Payment is due as specified in your booking confirmation or service agreement. Deposits or prepayment may be required for events, group bookings, and executive protection engagements.
  • By providing a payment method, you authorize us to charge the fare, applicable fees, and any additional charges incurred in connection with your service.

4. Cancellations and No-Shows

Cancellations, modifications, no-shows, and wait time are governed by our Cancellation Policy, which is incorporated into these Terms by reference. Please review it carefully, as cancellation fees may apply.

5. Client Conduct and Responsibilities

To ensure the safety and comfort of all passengers and personnel, you and your guests agree to:

  • Comply with all applicable laws during service.
  • Follow the reasonable instructions of the chauffeur or protection personnel regarding safety, including seatbelt use.
  • Refrain from illegal activity of any kind while using our services.
  • Not transport or use illegal drugs or contraband in our vehicles.
  • Not possess or transport illegal weapons in our vehicles.
  • Not engage in violent, threatening, abusive, or harassing behavior toward our personnel or others.
  • Respect the passenger capacity of the vehicle; we will not exceed the seating and safety capacity of any vehicle.

We reserve the right to refuse or terminate service, without refund, if these responsibilities are violated or if continuing service would be unsafe or unlawful.

6. Vehicle Care, Damage, and Cleaning

  • You are responsible for any damage to a vehicle caused by you or your guests during service, beyond normal wear.
  • Excessive cleaning required as a result of spills, illness, smoking, or other misuse will incur a cleaning fee charged to your payment method.
  • Smoking is prohibited in all vehicles.
  • We are not responsible for personal property left in a vehicle. We will make reasonable efforts to return recovered items, but assume no liability for loss.

7. Executive Protection and Secure Transportation

Executive protection and secure transportation services are provided by trained personnel and are subject to the following:

  • These services may be governed by a separate service agreement, which controls where its terms differ from these Terms.
  • Our personnel provide professional protective services within the scope of applicable law. We do not guarantee against all possible risks, and our services are provided on a reasonable-efforts basis consistent with professional standards.
  • You agree to provide accurate information necessary to plan and deliver these services safely and to cooperate with reasonable security recommendations.

8. Delays and Timeliness

We make every effort to provide punctual service and build in appropriate scheduling buffers. However, we are not liable for delays or failures caused by circumstances beyond our reasonable control, including traffic, weather, road conditions, accidents, flight delays, mechanical failure, or force majeure events (see Section 11). We are not responsible for missed flights, appointments, connections, or other consequential losses resulting from such delays.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Stealth Protection's total liability arising out of or relating to any service or these Terms shall not exceed the amount you paid for the specific service giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, missed connections, missed events, or lost business opportunities, even if advised of the possibility of such damages.
  • Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Insurance

Stealth Protection maintains commercial insurance as required for its operations. Our liability is subject to the terms, conditions, and limits of that coverage and the limitations set out in these Terms.

11. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, fire, flood, epidemic or pandemic, government orders or restrictions, civil unrest, strikes, road closures, accidents, utility or network failures, or acts of terrorism.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stealth Protection, its owners, employees, chauffeurs, and personnel from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your misuse of our services.

13. Intellectual Property

All content on our website, including text, graphics, logos, images, and the Stealth Protection name and branding, is the property of Stealth Protection LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use our content or branding without our prior written permission.

14. Website Use

You agree to use our website lawfully and not to interfere with its operation, attempt unauthorized access, or use it to transmit harmful code. Our website and its content are provided "as is" without warranties of any kind, to the extent permitted by law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York, unless otherwise required by law. You agree to attempt to resolve any dispute with us informally by contacting us first before pursuing formal action.

16. Changes to These Terms

We may modify these Terms at any time. The version in effect at the time of your booking applies to that service. The current version is always posted on our website, and your continued use of our website or services after changes take effect constitutes acceptance.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Cancellation Policy, SMS Policy, and any signed service agreement, constitute the entire agreement between you and Stealth Protection regarding your use of our website and services.
